Welcome to Stream ABA. These Terms of Service ("Terms") govern your access to and use of the Stream ABA platform and services (the "Service") provided by STREAM ABA LLC ("Stream ABA," "we," "us," or "our").

Stream ABA provides a cloud-based practice management platform designed for Applied Behavior Analysis (ABA) therapy practices. The Service includes features for:
- Scheduling and appointment management
- Clinical documentation and session notes
- Data collection and behavior tracking
- Billing and claims management
- Reporting and analytics
- Client and staff management
The Service is intended for use by licensed healthcare professionals, ABA therapy practices, and their authorized personnel.
3. Account Registration and Security
3.1 Account Creation
To use the Service, you must create an account and provide accurate, complete, and current information. You agree to update your information to keep it accurate and current.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Ensuring that users you authorize comply with these Terms
3.3 Account Types
The Service offers different account types with varying access levels. Account administrators are responsible for managing user access and permissions within their organization.
4. Subscription and Payment
4.1 Subscription Plans
The Service is offered through subscription plans as described on our website. Features, pricing, and usage limits vary by plan.
4.2 Billing
You agree to pay all fees associated with your subscription plan. Fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
4.3 Payment Terms
- All fees are non-refundable except as expressly stated in these Terms
- We may change pricing with 30 days' notice before your next billing cycle
- Late payments may result in service suspension or termination
- You are responsible for all applicable taxes
4.4 Free Trials
We may offer free trial periods. At the end of a trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You agree not to:
- Violate any applicable laws, regulations, or professional standards
- Infringe upon intellectual property rights of others
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to harass, abuse, or harm others
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or transfer your access to the Service without authorization
6. Healthcare Compliance

If you use the Service to store, process, or transmit Protected Health Information (PHI), you must:

6.2 Professional Responsibility
The Service is a tool to assist healthcare professionals. It does not provide medical advice, diagnosis, or treatment recommendations. You remain solely responsible for:
- All clinical decisions and programming
- Accuracy of data entered into the Service
- Compliance with professional licensing requirements
- Obtaining appropriate consents from clients
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its software, design, features, documentation, and content, is owned by Stream ABA and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
7.2 Your Content
You retain ownership of all data, content, and information you enter into the Service ("Your Content"). By using the Service, you grant us a limited license to use Your Content solely to provide the Service to you.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or compensation.
8. Data and Privacy
Our collection and use of your information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.
8.1 Data Ownership
You own Your Content. We do not claim ownership of client data or PHI you enter into the Service.

You may export Your Content from the Service at any time through available export features or by contacting support at [email protected].
8.3 Data Security
We implement industry-standard security measures to protect your data. However, you are responsible for maintaining the security of your account credentials and devices.
9. Third-Party Services
The Service may integrate with or link to third-party services. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their content.
9.1 Analytics and Advertising
Our marketing website uses third-party analytics and advertising services, including Google Analytics, Google Ads, Meta (Facebook/Instagram), LinkedIn, and Reddit. These services may collect information about your visits to our website through cookies and similar technologies. Note: These tracking technologies are used only on our public marketing pages. They are not used within the authenticated application where Protected Health Information is stored.
10. Service Availability
10.1 Uptime
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability.
10.2 Modifications
We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes.
11. Termination
11.1 By You
You may terminate your account at any time through your account settings or by contacting us. Termination does not entitle you to a refund of prepaid fees.
11.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or our policies
- Fail to pay fees when due
- Engage in fraudulent or illegal activity
- Pose a security risk to the Service or other users
11.3 Effect of Termination
Upon termination:
- Your right to access the Service immediately ceases
- You may request export of Your Content within 30 days
- We will delete Your Content in accordance with our data retention policies, and no sooner than 90 days after your account is closed
- Provisions that should survive termination will remain in effect
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STREAM ABA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Stream ABA and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content or data you enter into the Service
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
15.2 Arbitration
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Wake County, North Carolina, and judgment on the award may be entered in any court of competent jurisdiction.
15.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions or class arbitrations.
15.4 Exceptions
Either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, Acceptable Use Policy, and any applicable BAA, constitute the entire agreement between you and Stream ABA.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
16.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms without restriction.
16.5 Notices
We may provide notices to you via email, in-app notifications, or posting on the Service. Notices to us should be sent to the contact information below.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
